The products purchased on https://www.ottokidsboutique.com/ are sold directly by MOMMYLOVE SRL ("Otto Kids' Boutique" or the "Seller"), a MOMMYLOVE SRL company with registered office in Italy, Foro Bonaparte n. 69 – 20121 - Milan, CF and VAT no. 12060080962.

  1. Our trade policy

1.1
The Seller carries out its e-commerce activity exclusively towards its end users who have reached the age of majority and who are "consumers".

1.2
When we talk about "consumer" we mean any natural person who acts on https://www.ottokidsboutique.com/ for purposes which are not related to his/her commercial, entrepreneurial or professional activity, if any. If you are not a "consumer", we invite you to refrain from concluding commercial transactions on https://www.ottokidsboutique.com/ .

In consideration of its commercial policy, the Seller reserves the right not to accept purchase order proposals from persons other than the "consumer" or in any case purchase order proposals that do not comply with its commercial policy, such as, for example, order proposals for which there is a report, or suspicion, of fraudulent or illegal activity. In such cases, the Seller will inform the user of the non-acceptance of the order proposal.

All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals sent and returns made.

These General Conditions of Sale exclusively regulate the sending of purchase order proposals for products available on https://www.ottokidsboutique.com/ by the user and their acceptance by the Seller.

  1. Information aimed at concluding the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70

2.1
Before sending the order proposal, we remind you to carefully read these General Conditions of Sale, to print a copy using the print command and to save or reproduce a copy for your personal use. In accordance with Article 51, paragraph 7, of Legislative Decree 6 September 2005, n. 206 (the “Consumer Code”), before sending the order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your order proposal for the purchase of the products and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the delivery methods of the products purchased, the shipping and delivery costs; as well as the references, geographical address and contact methods of the Seller and the date by which the Seller, once your order proposal has been accepted, undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable, you will be informed that, in the event of withdrawal, you will have to bear the cost of returning the products. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service and we will remind you of the possibility of using the independent and institutional conciliation service, called "RisolviOnline", provided by the Arbitration Chamber of the Chamber of Commerce of Milan as well as the possibility of using the platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr , made available by the European Commission.

2.2
On the order proposal confirmation page, which contains a link to these General Conditions of Sale, we will provide you with summary information about the essential characteristics of each product indicated in your order proposal, the price (including all applicable taxes or duties) and the shipping costs (including any additional costs incurred by you for having chosen a type of shipping and delivery different and/or faster than the standard one).

2.3
The transmission of the order proposal to the Seller constitutes a binding purchase proposal for the user. Before proceeding with the transmission of the order proposal, you will therefore be asked to identify and correct any errors in data entry.

2.4
Once you have submitted your order proposal, you will receive an automatic email from the Seller to confirm receipt of your order proposal. Receipt of the aforementioned email does not constitute acceptance of your order proposal.

2.5
The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second email to confirm acceptance of your order proposal and shipment of the products. This email will also contain a copy of the General Conditions of Sale.

2.6
The language available for concluding the contract with the Seller is Italian.

2.7
The Seller may not accept your purchase order proposals that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products.

In these cases, we will inform you by email that the contract has not been concluded and that the Seller has not accepted your purchase order proposal, specifying the reasons. If the products presented on https://www.ottokidsboutique.com/ are no longer available or on sale at the time of receipt or processing of your purchase order proposal, the Seller will inform you promptly and in any case within thirty (30) days from the day following the day on which you sent your order proposal to the Seller, of the possible unavailability of the products. If you have already paid the price for the products, the Seller will refund, without undue delay, the amount already paid by you and the sales contract will be considered terminated.

The Seller also reserves the right not to accept purchase order proposals in the cases referred to in the previous paragraph 1.3.

We remind you that, by electronically transmitting the order proposal, you unconditionally accept and undertake to observe, in your relations with the Seller, these General Conditions of Sale. If you do not agree with some of the terms set out in the General Conditions of Sale, we invite you not to submit your order proposal for the purchase of products on https://www.ottokidsboutique.com/ .

By submitting the order proposal, you confirm that you also know and accept the additional information contained in https://www.ottokidsboutique.com/ , also referred to via links, including the Privacy Policy .

  1. Guarantees and indication of product prices

3.1
The Seller sells exclusively products of its own production subjected to the most rigorous quality controls. In particular, the Seller markets:

Baby clothing, children's clothing and accessories.

3.2
The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.

3.3
The essential characteristics of the products are presented on https://www.ottokidsboutique.com/ within each product sheet. The images and colours of the products presented on https://www.ottokidsboutique.com/ may however not correspond to the real ones due to the Internet browser and monitor used.

3.4
Product prices may be subject to change. Please check the final sale price before submitting the relevant order proposal. In the event that a recognizable error is found in the indication - by Otto Kids' Boutique - of the price of a product or in the calculation of the amount requested for payment, Otto Kids' Boutique will not accept the order proposal and will contact the user in order to offer the opportunity to submit the purchase order proposal for the product(s) at the correct price.

3.5
All products sold by Otto Kids' Boutique are covered by the legal guarantee of twenty-four (24) months for lack of conformity, in accordance with the applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months of its discovery. The lack of conformity can be communicated to the Seller by contacting Customer Service. In the event of a lack of conformity, you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively onerous, you will be entitled to a reduction in the price paid or to the termination of the sales contract, pursuant to art. 130 of the Consumer Code.

  1. Payments

4.1
To pay the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order proposal form. Payment can be made by Visa, Mastercard, American Express, Paypal credit cards . In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you.

4.2
In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to [...] or to other banks, which provide the related remote electronic payment services, without third parties being able to access them in any way. Furthermore, such information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on https://www.ottokidsboutique.com/ . The price for the purchase of the products and the shipping costs, as indicated in the order proposal, will be charged to your current account at the time of shipment of the purchased products.

  1. Shipping and delivery of products

To find out the specific shipping and delivery methods for the products, log in to your Otto Kids' Boutique account or ask at shop.ottokidsboutique@gmail.com Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time of transmission of the order proposal.

5.2

The risks relating to the products will pass to the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to the same, including shipping costs, is received, or at the moment of delivery, if this occurs at a later time.

5.3

Shipping charges vary depending on the destination and total value of your order. Your rate will be automatically calculated at checkout. We aim to dispatch all orders within 24 hours (Monday to Friday unless otherwise stated, such as during holidays or peak periods such as during sales). Estimated delivery time varies between 3 and 5 working days and should be used as a guide only and is calculated when your order has been dispatched from our store.

  1. Right of withdrawal

7.1

Pursuant to Article 64 of Legislative Decree no. 206/2005, the consumer has the right to withdraw from the purchase contract for any reason, without the need for explanations and without any penalty, according to the terms and methods set out in the following articles.

7.2

To exercise the right of withdrawal referred to in the previous article 7.1, the Customer must send Otto Kids' Boutique a notice of withdrawal within 14 working days from receipt of the products in relation to which this right is claimed. The customer must send an email to shop.ottokidsboutique@gmail.com communicating the desire to make the return. The communication must contain the order number, which and how many products he wants to return in the event that the order is composed of multiple items, and the customer must also specify the reason. Customercare will process the return request and will send the necessary information and the address where to send the goods.

7.3

The product to be returned must reach Otto Kids' Boutique within 10 days of receiving the aforementioned authorization to return the goods. For this purpose, reference will be made to the date of delivery to the post office or courier.

7.4

The purchased Product must be returned unused with the Otto Kids' Boutique brand and labels and in its original packaging (including original packaging and boxes as well as any other accessories such as, for example, hangers and protective bags). In any case, no tags or adhesive tape must be placed directly on the original packaging of the Product.

7.5

The delivery costs resulting from the return of the products will be borne by the customer; the costs of delivery to the customer, as well as any other additional costs and / or taxes indicated at the time of the order will not be refunded.

The Customer will be solely responsible for delivery until the goods arrive at Otto Kids' Boutique and a receipt will be issued certifying the arrival of the products at the MOMMYLOVE SRL warehouse (if provided by the courier chosen by the customer).

7.6

If the order concerns more than one product, it will be possible to exercise the right of withdrawal in relation to one or more of the products ordered, specifying in the withdrawal communication, referred to in the previous article 7.2, the description of the products to be returned.

Otto Kids' Boutique will not be responsible in any case for damage or theft / loss of products during shipment by the customer.

  1. Refund times and methods

8.1
Whatever the payment method used by you, the refund due, whether full or partial, is activated by the Seller, as quickly as possible and in any case within (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verifying the correct execution of your right of withdrawal and checking the returned products.

8.2
The Seller will refund using the same means of payment you used to purchase the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not incur any additional costs as a consequence of the refund. If there is no correspondence between the recipient of the products indicated in the order proposal and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be made by the Seller, in any case, to the person who made the payment.

8.3
We remind you that the value date of the re-credit is the same as the debit; consequently you will not suffer any loss in terms of bank interest.

10.1
Without prejudice to the application of mandatory European consumer protection provisions, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, no. 70 (“Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce”).

10.2
In the event of disputes between the Seller and each end user, arising from the General Conditions of Sale, the Seller guarantees, from now on, full adhesion and acceptance of the RisolviOnline conciliation service. RisolviOnline is an independent and institutional service, provided by the Arbitration Chamber of the Chamber of Commerce of Milan, which allows you to reach a satisfactory agreement, with the help of a neutral and competent conciliator, on the Internet. We also inform you that the European Commission provides a platform for alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr .

10.4
For all disputes relating to purchases and/or these General Conditions of Sale, the Court of the place of domicile or residence of the consumer shall have jurisdiction in accordance with the applicable law or, at the consumer's choice, the Court of Milan.

The General Conditions of Sale are modified from time to time by the Seller also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on https://www.ottokidsboutique.com/ .
